Agrawal Order On Board 06/10/2017 (1) Learned counsel appearing for the petitioner would submit that against the order dated 1.07.2015 the petitioner has made representation to the Collector, Janjgir-Champa as well as Commissioner (Excise), Raipur, but his application has not considered and decided against the levy of excise duty and fee which is not recoverable from him.

(2) Learned counsel appearing for the State would submit that the petitioner's representation shall be considered and decided, expeditiously.

(3) In view of submission made by learned counsel for the State, the instant writ petition is disposed of with a liberty to the petitioner to file fresh representation and raise all the legally permissible grounds before the Commissioner (Excise), Raipur within a period of seven days from today, in that event the said authority shall consider and decide the petitioner's representation after affording an opportunity of hearing to the parties, expeditiously preferably within a further period of three weeks from the date of receipt of representation. (4) With the aforesaid observation, the writ petition stands finally disposed of. No order as to costs.
