The applicants have preferred this second bail application under Section 439 of the Cr.P.C. for grant of bail as they have been arrested in connection with Crime No.486/2020, registered at Police Station Basna, District Mahasamund

MCRC No.3798 of 2021 (CG), for the offence under Section 20(b) of the Narcotic Drugs and Psychotropic Substances Act, 1985.

The first bail application was dismissed on merits with the observation that if the trial does not demonstrate sufficient progress within next four months, the applicants would be at liberty to repeat the prayer immediately thereafter. 4.

The applicants have been arrested for illicit possession of 8 kg. 300 gms. of Ganja. They are in jail since 14-10-2020. 5.

Considering the length of pre-trial detention, I am of the opinion that present is a fit case to release the applicants on regular bail.

Accordingly, the bail application is allowed and both the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.1,00,000/- with two local sureties in the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court. 7.
