The grievance of the petitioner is that though he has been appointed in the year, 2013, till date he has not been issued with an order of confirmation though probation period had already completed. 2.

At this juncture counsel for the State submits that perhaps there is an enquiry going on so far as the recruitment in which the appointment of the petitioner were made and there is also a proceeding pending in respect of the same recruitment process before office of Lokayukta and Special Investigating Team has also been constituted to verify whether there has been any lapse in the recruitment process in which the appointment of the petitioner was made or not.

This being admitted position and which is not disputed by the counsel for the petitioner. Therefore, this court is of the opinion that at this juncture it would not be appropriate for this court to issue a direction to the respondents to consider the claim of the petitioner for confirmation. Subject to outcome of the enquiry, the respondents would be at liberty to

issue appropriate order including the decision on the confirmation of the petitioner as he has already completed the probation period. 4.
