1. The applicants have preferred this application under Section 439 of the Cr.P.C. for grant of regular bail as they are arrested in connection with crime No.137/2021 registered in Police Station Tamnar District Raigarh for the offence punishable under Sections 147, 149, 302 of the I.P.C.
2. Applicants have committed murder of deceased Rajaram by assaulting him by hand and fist. There are four
MCRC No. 3996 of 2021 eyewitnesses namely; Govind Rathia, Kalawati Rathia, Prahlad Rathia and Sadhani Bai.
3. Considering the eyewitnesses account rendered by the above witnesses, I am not inclined to release the applicants on bail at this stage.
4. Accordingly, the bail application is dismissed reserving liberty in favour of the applicants to revive the prayer after examination of above named eyewitnesses.
