1. Petitioner's application for taking document on record i.e. deposition of the respondent/wife and her witnesses has been declined on the ground that it is not relevant.

2. Learned counsel for the petitioner would submit that the order passed by the Family Court, Janjgir is unsustainable and bad in law.

3. On the other hand, learned counsel for the respondent would oppose the writ petition.

4. Taking into consideration the statement made by other side, it would be expedient to take the aforesaid document on record subject to payment of cost of ₹2000/- to the respondent. Therefore, the impugned order is set aside and document filed by the petitioner is directed be taken on record subject to payment of cost of ₹2000/- to the respondent.

5. The writ petition is allowed to the extent indicated hereinabove. No order as to cost(s).
