1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.145/2021 registered at Police Station Basantpur, District Rajnandgaon (CG) for the offence punishable under Sections 307 of the IPC and 25, 27 of the Arms Act.

3. The applicant has inflicted knife blows to injured Omprakash, Ravi Sinha and Mohisin Khan. Om Prakash has sustained incised wound over left side of the neck and was advised for X-Ray to

MCRC No. 4260 of 2021 ascertain the nature of injury but the X-Ray report is not available in the case diary. Injured Ravi Sinha and Mohisin Khan have sustained simple injuries.

4. Learned counsel for the State would oppose the prayer for grant of bail on submission that the applicant has one more criminal case registered against him for the offence under Sections 25 & 27 of the Arms Act.

Considering the entire facts situation of the case particularly for the reason that the applicant is in jail since 29.3.2021 i.e. for more than 4 months; the charge sheet has already been filed and the injuries caused to two injured are simple in nature and for the third injured, the nature of injury is not ascertained because X-Ray report is not available, I am inclined to release the applicant on regular bail.

Accordingly, the application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
