2. Learned counsel for the petitioner would submit that the petitioner, who is working as Draftman at Kelo Project Construction Division, Lakha Kharsiya has been transferred to Mini Mata Bango Bandh Division No.3, Machadoli, whereas, one

H.K. Sao, another Draftsman, has also been transferred to the same place and the said H.K. Sao has already joined at the place leaving no vacancy for the petitioner to work as Draftsman at Mini Mata Bango Bandh Division No.3, Machadoli. He would draw attention of this Court to the document- Annexure P/5 mentioning the number of sanctioned post of Draftsman at Mini Mata Bango Bandh Division No.3, Machadoli as in the month of September 2017.

3. A perusal of the document - Annexure P/5 would indicate that there is only post of Draftsman at Mini Mata Bango Bandh Division No.3, Machadoli.

4. Considering the entire facts' situation of the case, the writ petition is disposed of with direction that in the event, the petitioner prefers a representation before the competent authority within a period of one month from today, the said authority shall consider and decide the representation keeping in view of the grounds urged in the representation as well as the grounds urged before this Court, as stated above.

5. Till the petitioner's representation is decided, the effect and operation of the impugned order in respect of the petitioner's posting shall remain stayed. Sd/- Judge (Prashant Kumar Mishra) Shyna
