Ajay Kumar Bajpai -Versus- Shri Subrat Sahu 29/10/2021 Mr. Rishi Rahul Soni, Advocate for the petitioner. Mr. Jitendra Pali, Advocate for the respondent. The present contempt petition has been filed alleging noncompliance of the order dated 15.02.2021 passed in WPS No. 744/2021. The present contempt petition was filed on 03.06.2021. Today when the matter is taken up for hearing, learned counsel appearing for the parties fairly submit that pending the contempt petition on 08.06.2021 itself, the authorities have decided the appeal. The fact that the appeal has been decided, the order passed by this Court stands complied with. If the order passed by the Appellate Authority in the appeal is not in favour of the applicant/petitioner, the same would be a fresh cause of action. The veracity of that order cannot be tested exercising the contempt jurisdiction of this Court.

Reserving the right of the petitioner to avail appropriate remedies available to him, the contempt petition at this juncture stands disposed of. Sd/- (P. Sam Koshy) JUDGE Ved
