This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.62/2021 registered at Police Station Kansabel, District Jashpur (CG) for the offence punishable under Sections 366 and 376 of the IPC. 3.

The prosecutrix is a grown up woman, aged about 31 years. As per the allegations, the applicant committed forcible sexual

MCRC No. 3797 of 2021 intercourse with the prosecutrix since after 2014 onwards on promise to marry and thereafter, refused to marry her. The applicant also created fake facebook profile of the prosecutrix and uploaded her obscene photographs.

Considering the delay in lodging the FIR and that the applicant is in jail since 25.5.2021 and the charge sheet has already been filed, this Court is inclined to release the applicant on regular bail.

Accordingly, the application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
