Hon'ble Shri Justice Goutam Bhaduri Order on Board 18.04.2019
1. The limited grievance which the petitioners have raised in the present writ petition is that the petitioners became entitled for the benefit of time pay scale w.e.f. July, 2013 but the same has been granted to the petitioners only w.e.f. 16.02.2018 and as such the petitioners have substantially been put to monetary loss for a period of about 5 years.
2. Counsel for the petitioners submits that they ought to have been paid the benefit of time pay scale from the date they have completed 20 years of service which in the present case in respect of all the petitioners was from July, 2013.
3. Perusal of the record would show that the petitioners have not made any representation in this regard to the respondents ventilating their grievances.
4. Given the said fact, let the petitioners approach the Department for redressal of their grievance first by making a suitable representation within a period of 2 weeks from the date of receipt of certified copy of this order. On such representation being made within the stipulated period, respondent no.2 is directed to take a decision on the said representation at the earliest keeping in view the government circulars and instructions governing the field within an outer limit of 4 months from the date of receipt of representation of the petitioners.
