---- Respondent _____________________________________________________________________ For Petitioner:
: Mr. Om Prakash Sahu, appears in person.
-------------------------------------------------------------------------------------------------------- Single Bench:Hon'ble Shri Sanjay S. Agrawal, J Order On Board 08.03.2021 1.
This petition has been filed for initiating the contempt proceedings against the respondent for violation of the order dated 06.03.2019 (Annexure C-1) passed by this Court in WPC No. 845/2019, whereby the following direction has been issued :- "Meanwhile, purely as an interim measure, it is directed that the effect and operation of the impugned notice dated 02.03.2019 directing the petitioner to remove encroachment by 06.03.2019 shall remain stayed till the next date of hearing."
2.
By virtue of the aforesaid direction, the effect and operation of the impugned notice dated 02.03.2019, whereby the petitioner has been directed to remove the encroachment by 06.03.2019 has been stayed till the next date of hearing. However, from bare perusal of the allegations made in the petition,
it appears that the allegation, which has been made, is only with regard to the initiation of the demarcation proceedings by the respondent and not with regard to the removal of his encroachment in pursuance of the impugned notice dated 02.03.2019. As such, I am not inclined to draw the contempt proceedings, as alleged by the petitioner herein. 4.
The petition is accordingly dismissed at admission stage itself. No order as to costs.
