1. The applicant has preferred this application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.64/2021 registered in Police Station Narharpur, Distt. North Baster Kanker C.G. for the offence punishable under Section 302 of the I.P.C.

2. Applicant has allegedly committed murder of deceased Parasram Nag on suspicion that he was having illicit relation with his wife. The incident took place on 28.5.2021 and the FIR was lodged on the very next day and on the same day

MCRC No. 3936 of 2021 applicant's memorandum statement was recorded leading to recovery of axe and club from applicant's possession.

3. Learned State counsel would oppose the prayer for grant of bail.

4. Considering the nature of allegation, I am not inclined to release the applicant on bail at this stage.

5. Accordingly, the bail application is dismissed, however, the applicant would be at liberty to revive the prayer after examination of the witnesses to memorandum and seizure. Sd/- (Prashant Kumar Mishra) Acting Chief Justice Ayushi
