1. Heard learned State counsel on I.A. No.1 as also on admission.

2. This is an application for condonation of delay in filing the application seeking leave to appeal.

3. On due consideration, the application is allowed and delay

CRMP No. 1125 of 2019 of 07 days in moving the application is condoned. Accordingly, I.A. No.1 stands disposed of.

4. This application seeking leave to appeal has been preferred to call in question the judgment of acquittal rendered by the trial Court acquitting the accused of the charge under Section 307 of IPC. The accused and the injured/victim are related to each other as son and mother. Although, the injured has suffered head injury but she has turned hostile and has not supported the case of prosecution.

5. Considering the statement of the injured and their relation with each other, the present is not considered to be a fit case for grant of leave to appeal, accordingly, prayer for grant of leave to appeal is dismissed.
