Agrawal Order On Board 14/12/2017 (1) Learned counsel appearing for the petitioner would submit that respondent no.1/wife is not appearing in the proceeding initiated by the petitioner/husband under Section 126(2) of CrPC before the Second Additional Principal Judge, Family Court, Raipur whereas she has obtained execution order from the Court of First Additional Principal Judge, Family Court, Raipur.

(2) Be that as it may, the petitioner is at liberty to make a representation before the Second Additional Principal Judge, Family Court, Raipur for analogous hearing of the application under Section 126(2) of CrPC and the said execution case pending before the Court of First Additional Principal Judge, Family Court, Raipur.

(3) With the aforesaid observation, the writ petition stands finally disposed of. No order as to costs.
