The instant petition has been preferred for issuance of directions to the learned Family Court, Raigarh to decide the pending petition under Section 13 of the Hindu Marriage Act, 1955 filed by the petitioner. 2.
Counsel appearing on behalf of the petitioner submits that the petitioner has filed a petition under Section 13 of the Hindu Marriage Act, 1955 before the learned Family Court, Raigarh on 14/07/2017, but the same has not been decided till date, therefore, he submits that a direction may be issued to the Family Court to expedite the proceeding.

After perusal of the documents annexed with this petition, It is clear that the petition is pending since more than 3 years and no concerted effort has been made by the learned Family Court to expedite the
Page No.2 proceeding for early disposal of the case. Hence, I am of the view that such direction is required.

Consequently, this petition is disposed of at the motion stage. 5.
The learned Family Court is directed to expedite the proceeding and decide the petition filed under Section 13 of the Hindu Marriage Act, 1955 of the petitioner, within 6 months from the date of passing of this order.
