NAFR HIGH COURT OF CHHATTISGARH, BILASPUR MCRCA No. 933 of 2015 Subhash Bhansali S/o Shri Multan Chandji Bhansali Aged About 55 Years R/o Jangalpara Nagari, Post And Thana Nagari, Distt. Dhamtari Chhattisgarh. ---- Applicant
Versus
State Of Chhattisgarh Through Police Station Moudhapara, Distt. Raipur Chhattisgarh. ---- Respondent For Applicant :
Dr. T.N. Dubey, Advocate.
For Respondent/State :
Shri Satish Gupta, Government Advocate.
Order On Board 23/09/2015 Heard.
1.
The applicant is apprehending his arrest in connection with Crime No.33/2015 registered at police station - Moudhapara, Distt. Raipur Chhattisgarh for alleged commission of offence under Section 420, 467, 468, 471/34 of IPC. 2.
Case of the prosecution is that the co-accused contacted the applicant for getting prepared a forged and fabricated insurance policy to cover insurance of a vehicle, which had already met with an accident on 21.08.2014 and it was not insured at that point of time. 3.
Learned counsel for the applicant submits that the applicant is being involved without any basis only on the memorandum statement of the co-accused, which cannot be made a basis to involve him. There is no evidence so far collected by the prosecution against the applicant to show that any amount was transferred from the account of the co-accused to the applicant's account nor is there any material collected by the prosecution agency that the applicant had contacted any officer or employee of the insurance company in connection with preparation of forged and fabricated insurance policy. 4.
On the other hand, learned counsel for the State opposes prayer for grant of
anticipatory bail.
5.
Taking into consideration the memorandum statement of the co-accused that the forged covered note was prepared by the applicant and the complainant had paid him Rs.1,70,000/- for preparing forged cover note policy to cover the vehicle towards insurance, I am not inclined to grant benefit of anticipatory bail to the applicant. 6.
The bail application is rejected.
