The applicant has preferred this bail application under Section 439 of the Cr.P.C. for grant of bail as he has been arrested in connection with Crime No.141/2021, registered at Police Station Navagarh, District Bemetara (CG), for the offence under Sections 294, 506B, 323, 147, 148, 149 & 302 of the Indian Penal Code.

Out of eight accused persons against whom charge sheet for the subject offence has been filed for committing murder of

MCRC No.3846 of 2021 Parasram Sahu (since deceased) and causing injuries over the persons of injured eyewitnesses namely; Satwantin Bai (wife of the deceased) and Rohit Sahu (son of the deceased), the allegation of assault has been levelled against Hira Sahu, Ravi Sahu, Chabi Sahu, Ganesh Sahu & Sonu Sahu. There is no allegation that the present applicant, who is a lady, aged about 32 years, also participated in causing injuries over the person of deceased or over the persons of Satwantin Bai & Rohit Sahu.

Learned counsel for the State, per contra, would oppose the bail application.

Considering the entire facts situation of the case; particularly considering the nature of evidence against the present applicant, a lady, aged about 32 years; as also for the fact that the applicant is in jail since 31-4-2021; and the charge sheet has already been filed, I am of the opinion that present is a fit case to release the applicant on regular bail. 6.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on her executing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. She is directed to appear before the trial Court on each and every date given by the said Court.
