After arguing for some time, learned counsel for the applicant seeks permission of this Court to withdraw the bail application with liberty to file an application before the Court below for grant of regular bail, as the other co-accused has already been released on regular bail. Learned counsel submits that as the allegation against the applicant is only purchasing the alleged stolen cylinders, the Court below may be directed to consider and decide the bail application at the earliest.

Accordingly, the application (M.Cr.C. (A) No.917 of 2015) is dismissed as withdrawn with the aforesaid liberty. If the bail application is filed by the applicant for grant of regular bail before the Court below, the same shall be considered and decided, if possible on the same day or in any case within a period of two days.
