1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.314/2020 registered in Police Station: Purani Basti, Raipur District Raipur for offence under Section 302/34 of the IPC and Section 25 & 27 of the Arms Act.
2. On account of dispute concerning delay in supply of sand for widening of road, the accused persons allegedly committed murder of deceased Chandrahas Sahu at about 6.30 pm on 12.11.2020.
3. As per the material available in the case diary, the deceased was stabbed by knife by Sandip (juvenile), son of co-accused Laxmi Sahu. As against this applicant, there is no allegation of causing any blow by
MCRC No.3841 of 2021 means of any weapon on the person of the deceased. There is no allegation either to the effect that he caught hold of the deceased at the time Sandip inflicted stab wound.
4. Considering the quality of evidence against the present applicant and for the fact that he is in jail since 14.11.2020 and charge sheet has already been filed, I am inclined to release the applicant on bail.
5. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
