1. Heard learned State counsel on I.A. No.1 as also on admission.

2. This is an application for condonation of delay in filing the application seeking leave to appeal.
3. On due consideration, the application is allowed and delay of 495 days in moving the application is condoned.
4. Accordingly, I.A. No.1 stands disposed of.
5. The accused have caused injuries over the abdomen of the injured PW-2 Munna, by means of arrow.
6. Considering the statement of PW-2 Munna and the medical evidence rendered by PW-4 Dr. B.K. Jhalariya, we are satisfied that the present is a fit case for grant of leave to appeal.
7. Accordingly, Cr.M.P. is allowed and the appellant is permitted to prosecute acquittal appeal.
8. Let Registry register the regular acquittal appeal. Notice thereof to be issued to the respondents on payment of process fee per rules.
