Hon'ble Shri Justice Sharad Kumar Gupta Order On Board 10-51. This is second bail application under Section 439 of Cr.P.C. preferred by the applicant. His first bail application being MCRC No. 1943/2019 was dismissed by this Court for want of prosecution vide order dated 5-4-2019.

2. The applicant has been arrested in connection with Crime No. 110/2018 registered in police station Marwahi, Distt. Bilaspur (CG) for offence punishable under Sections 379, 34 of IPC.

3. Perused the case diary.

4. Prosecution story in brief is that on 10-8-2018 near Jafar Boot House, Marwahi, some unknown person stole Rs. 30,000/- and coins of Rs. 1,500/- from the dickey of motorcycle of complainant Govind Gupta. On the memorandum of applicant, Rs. 1,000/- have been seized from him.

5. Counsel for the applicant argued that the applicant is innocent and has been falsely implicated hence he be released on bail.

6. On the other hand, the State Counsel opposed the bail application. He further submits that two cases of similar type have been registered against him.

7. Looking to the above facts and circumstances of the case, as the trial will take its own time, application is allowed. It is ordered that if the applicant furnishes two solvent sureties each for a sum of Rs. 25,000/- along with one personal bond of Rs. 50,000/- to the satisfaction of the trial Court concerned with the condition that he will not involve himself in similar type of offence, he be released on bail.
