The applicant is apprehending his arrest in connection with Crime No.115/15 registered at police station - Sariya, Civil and Revenue District - Raigarh (CG) for alleged commission of offence under Section 307 of IPC. 2.
Case of the prosecution is that the applicant gave repeated knife blows resulting in serious injury on the head and occipital fracture on the victim. 3.
Learned counsel for the applicant submits that the applicant had no intention to cause death as the complainant was misbehaving with applicant's wife in a village function fair, which was objected to and dispute cropped up. 4.
Learned State counsel opposes the prayer for grant of bail and submits that as per the FIR and statement of the victim, the applicant came from behind and inflicted knife blows on the head of the complainant, which prima facie shows intention to cause death.

Taking into consideration the nature of allegations, statement of victim and the injury sustained by him, no case of anticipatory bail is made out. 6.
The application is therefore rejected.
