Hon'ble Shri Justice Sharad Kumar Gupta Order On Board 5-71. Apprehending his arrest, the applicant has filed this application for grant of anticipatory bail under Section 438 of the Cr.P.C. in connection with Crime No.50/2018 registered in Police Statin Somani, Distt. Rajnandgaon for offence punishable under Section 498-A of the I.P.C.

2. Prosecution story in brief is that the complainant is the resident of Bajar Chouk, Somni, Distt. Rajnandgaon. Her marriage was solemnized with the applicant on 26-10-2015 in accordance with rights and rituals of Arya Samaj. The applicant is not ready to keep the complainant with him though two years have passed. He took her to Dongargarh for committing sexual intercourse.

3. Counsel for the applicant argued that both, the applicant and the complainant, had initiated some proceedings against each other. These proceedings have terminated. Before termination of such proceedings, the complainant has not lodged any report against

the applicant. Counsel for the applicant argued that the applicant is innocent and may be granted anticipatory bail.

4. On the other hand, the Panel Lawyer appearing for the State opposed the bail application.

5. I have heard counsel for both the parties.

6. Looking to the facts and circumstances of the case, the allegations levelled against the applicant, I am not inclined to grant anticipatory bail to the applicant. The application is rejected.
