The applicant has preferred this bail application under Section 439 of the CrPC, as he has been arrested in connection with Crime No.274/2020, registered at Police Chowki Birejhar, Police Station Kurud, District Dhamtari (C.G.) for the offence punishable under Sections 363 & 354 of IPC and Section 8 of the POCSO Act.

The applicant has abducted the prosecutrix on a motorcycle and outraged her modesty. The prosecutrix is aged about 12 years and 4 months.

The mother of the prosecutrix has appeared through the High Court Help Desk. She objects to the applicant's prayer for grant

of bail.

Considering the nature of allegation and the objection by the mother of the prosecutrix, present is not a fit case for grant of bail at this stage.

Accordingly, the bail application is dismissed reserving liberty in favour of the applicant to revive the prayer after examination of the prosecutrix.
