Instant petition has been filed on the ground that on a subject issue about partition of the land initially the SDO has dismissed the case on 2/12/2020 against which an appeal was filed before the Commissioner and the Commissioner by its order dated 27/01/2021 has stayed the order of the SDO. Since there were different parties, one of the parties again filed an application before the SDO and the SDO has passed an order dated 3/04/2021 whereby stay has been granted. 2.
Primary reading of the document would show that already issue is
pending before the Commissioner, therefore the petitioner may very well approach to the court of Commissioner with all the grievance and may seek any order, if so advised. This court therefore is refrained to exercise the jurisdiction under Article 226 of the Constitution of India to execute any order of the Commissioner. It is for the revenue authorities to take care of the fact that their orders are duly complied with. 3.
