This petition under Article 227 of the Constitution of India has been filed for issuance of suitable direction to the trial Court. 2.

It is submitted that arguments in the appeal filed by the petitioner were heard finally by the appellate Court and the case was reserved for judgment. The judgment of the co-accused persons in the same case was passed by the learned appellate Court on 24.04.2019, however, the judgment in the appeal filed by the petitioner was withheld and warrant of arrest was issued against him. The petitioner was then arrested and placed in detention in compliance with that order.

However, due to pandemic situation and lock-downs, the normal functioning of the Court has been affected and therefore, the judgment in the appeal filed by the petitioner could not be pronounced by the Sessions Court.

It is further submitted that in the meanwhile, the petitioner has been released on bail after suspension of sentence against him by the said appellate Court. Therefore, the only prayer made is this that the learned appellate Court be directed to pass judgment in the appeal filed by this petitioner as early as possible as soon as the normal functioning of the Courts are started.

State counsel has no objection if any such direction is issued to the trial Court.

After considering the submission so made, this petition is disposed off. The learned appellate Court is directed to dispose of the appeal filed by this petitioner as early as possible preferably within a period of one month from the date of normal functioning of the Court start.
