The applicant has preferred this bail application under Section 439 of the CrPC, as he has been arrested in connection with Crime No.243/2020, registered at Police Station Civil Lines, District Bilaspur (C.G.) for the offence punishable under Sections 457 & 380 of IPC.

The applicant and juvenile co-accused committed theft of cash valued at Rs.32,000/- from the counter of a dairy shop in the intervening night of 4th and 5th April, 2020. Stolen cash of Rs.9,000/- has been recovered from the applicant. 3.
Learned State counsel would oppose the bail application.

Considering the fact that the applicant is in jail since 29.04.2020; the offences are trialable by the JMFC and the charge sheet has already been filed, this Court is inclined to release the applicant on bail.

Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court.
