The applicants have preferred this bail application under Section 439 of the CrPC, as they have been arrested in connection with Crime No.152/2020, registered at Police Station Manendragarh, District Koriya (C.G.) for the offence punishable under Sections

147, 148, 149, 294, 506, 307, 201 & 212 of IPC. 2.

As per the prosecution case, the incident happened at 12 noon on 04.05.2020 when the injured was objecting to the encroachment and illegal construction made by the accused Pramod Agrawal over the land earmarked for Muktidham. The accused was assaulted by all the accused persons by means of club, hand and legs.

Learned State counsel and learned counsel for the objector would vehemently object to the prayer for grant of bail. 4.

The co-accused Ajay Prasad has already been released on regular bail vide order dated 15.06.2020 in MCRC No.3275/2020, whereas the co-accused Nisha Agrawal and Shashank Agrawal have been granted interim anticipatory bail vide order dated 02.07.2020 in MCRCA No.793/2020. 5.

Considering that the present applicants are in jail since 05.05.2020 and the co-accused has been enlarged on regular bail by this Court, the present bail application is allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
