Mr. Suryakant Mishra, Panel Lawyer for the State. Heard Mr. Alok Kumar Dewangan, learned counsel appearing for the appellant, is not able to argue the case finally and he wants to withdraw his power.

Perusal of the communication dated 06.07.2017 received from the Superintendent, Central Jail, Bilaspur, would show that the appellant has suffered his entire jail sentence and he has been released on 18.12.2008.

In view of this, Mr. J.K.Shastri, learned counsel for the appellant, do not want to press this appeal on merit.

Consequently, the appeal is dismissed as having become infructuous.
