(1) Learned counsel appearing for the petitioner would submit that issue involved in this writ petition is covered by order passed by this Court in Writ Petition (S) No. 4563/2006 {Abdul Nawab Khan & others Vs. The State of Chhattisarh & others and other connected cases}, decided on 7th May, 2009 , therefore, instant writ petition may be disposed of in terms of paragraph 10 of the aforesaid order, which reads as under:- "10. Applying the well settled principles of law to the facts of the present case and for the reasons mentioned hereinabove, the petitions are

accordingly allowed in the terms of the order passed in Vidyadhar Tiwari Vs. State of Chhattisgarh & others1 i.e., the impunged order dated 29-7-2006 is hereby quashed. The amount, if any, so deducted be paid to the petitioners with simple interest. However, liberty is reserved to the respondents, if so advised, to take appropriate steps after complying with the principles of natural justice in accordance with Rule 65 of the Chhattisgarh Civil Services (Pension) Rules, 1976. No order asto costs. Rule is made absolute."
