(1) Learned counsel for the applicant submits that by the impugned order dated 18.11.2013, amount of maintenance has been enhanced from Rs. 3,000/- to Rs. 15,000/- per month by the Family Court, Raipur; and the applicant has been proceeded ex parte on 12.08.2013. He further submits that the applicant had valid & sufficient cause for not appearing on 12.8.2013 and, therefore, he may be permitted to file application for setting aside ex-parte order dated 18.11.2013 passed by the Family Court,
Raipur before the Family Court.
(2) Prayer appears to be fair & reasonable.
(3) Accordingly, the applicant is at liberty to file application for setting aside ex-parte order dated 18.11.2013 within a month from today; and if the application is filed along with application for condonation of delay in filing the same, the same shall be decided by the Family Court in accordance with law expeditiously keeping in view the fact revision remained pending before this Court from 23.12.2014 till this date.
(4) With the aforesaid observations, the criminal revision stands finally disposed of.
(5) Certified copy, as per rules.
