The present application has been preferred seeking restoration of Writ Petition (S) No. 5951 of 2011 which was dismissed for want of prosecution on 05.02.2016.

The learned Counsel for the Applicant submits that the Applicant is still interested in pursuing the Writ Petition. For some bonafide

reasons he or his Counsel could not appear before the Court when the case was called on 05.02.2016 and hence, it got dismissed for want of prosecution.

Considering the total facts and circumstances of the case and reasons which have been explained in the application for nonappearance, the present M.C.C. stands allowed. The Writ Petition (S) No. 5951 of 2011 is restored to its original number. 4.

No order as to costs.
