Hon'ble Shri Justice P. Sam Koshy Order on Board 06/05/2019
1. The demand made by the petitioner through the present writ petition is for an appropriate change of posting in the light of an alleged
threat made upon the petitioner and his family from the so called Naxalites/Maoists.
2. Counsel for the petitioner referred to Annexure P-2 dated 19.05.2018 which is said to have been issued from the office of respondent no.5 affirming the threat factor prevailing upon the petitioner and his family.
3. Given the aforesaid facts and circumstances of the case and taking note of the fact that the petitioner's service now stands absorbed in the Education Department, this Court is of the opinion that ends of justice would meet if the writ petition can be disposed of with a direction to respondent no.1 to consider the change of place of posting of the petitioner to a suitable place after calling a fresh report from respondents 5 & 6 in respect of the threat perception that the petitioner carries.
4. The writ petition accordingly stands disposed of with a direction to respondent no.1 to take an appropriate decision at the earliest preferably within a period of 90 days from the date of receipt of copy of this order and after calling for a fresh report by respondents 5 & 6.
