Heard on application for condonation of delay in filing restoration petition.

Upon due consideration, application supported by fresh and detailed affidavit, I am inclined to condone the delay in filling the restoration petition.

Accordingly, delay in filing the restoration petition is hereby condoned.

Also heard on restoration petition.

Having gone through the application for restoration and other facts,

which has been stated in the affidavit, I am satisfied that sufficient cause has been made out for non-appearance of the counsel when the case was called on for hearing on 30/06/2011.

Accordingly, the MCC is allowed. The order of dismissal dated 30/06/2011 is hereby recalled and the WP(S) No.1745/2011 is restored to its original number.
