This is third bail application under Section 439 of Cr.P.C. The first bail application was rejected on 12/01/2016 vide M.Cr.C. No.6949 of 2015 and second bail application was rejected on 12/04/2017 vide M.Cr.C. No.2025 of 2017.

The applicant has preferred this application for grant of bail as she is arrested in connection with Crime No.145/2015 registered in Police Station Pandri, District Raipur (C.G.) for offence punishable under sections 420, 467, 468, 471, 120-B/34 of IPC. 3.

As per the prosecution case, the applicant alongwith other coaccused Prashant Sharma and Sunita Sharma obtained different amounts from different persons to get them employed in Government department and thereafter has received huge amounts from them, therefore offence is committed.

Learned counsel for the applicant submits that the trial has not been concluded till date and the applicant is in jail since 13/06/2015 and

there is every likelihood that trial will take further some time, therefore the applicant may be released on bail.

Learned State counsel opposes the prayer for grant of bail. 6.

Considering the fact that the applicant is a lady and is in jail since 2015, trial is not yet concluded, considering the pre-trial detention without going into merits of the case, this court is inclined to release the applicant on bail.

Accordingly, the third bail application is allowed and it is directed that the applicant shall be released on her furnishing personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of concerned trial court for her regular appearance before it as and when directed.
