1. This writ petition has been filed claiming promotion from the post of Assistant Commissioner, Tribal Development to the post of Deputy Commissioner, Tribal Development.

2. Learned counsel for the petitioner submits that in the meanwhile, during the pendency of the writ petition, the petitioner has been promoted on the post of Deputy Commissioner in the year 2011 and his case for consequential benefits from the year 2006 has already been forwarded by the Commissioner, Tribal Development, Raipur to

the Additional Chief Secretary, Tribal Development, Government of Chhattisgarh by letter dated 5-4-2014, but the State Government has not considered and decided the case of the petitioner. However, learned State counsel would support the State action.

3. Be that as it may, the State Government is directed to consider the case of the petitioner and the representation, if any, for consequential benefits strictly in accordance with law within a period of three months from the date of receipt of a copy of this order. The petitioner is at liberty to file additional representation bringing all the facts to the notice of the State Government. It is made clear that this Court has not expressed any opinion on the merits of the matter.

4. With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
