1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicants, who have been arrested in connection with Crime No.53/2021 registered at Police Station Charcha, District Koriya (CG) for the offence punishable under Section 379 of the IPC.

3. The applicants have committed theft of 15 Panasonic batteries from five different mobile tower locations. In addition to the

MCRC No. 3997 of 2021 present crime, three more crimes have been registered against the applicants. However, as stated by learned counsel for the applicants, the applicants have already been released in the remaining three cases.

4. Considering that the applicants are in jail since 6.5.2021 i.e. for last about 2 1⁄2 months, this Court is inclined to release the applicants on regular bail.

5. Accordingly, the application is allowed and the applicants are directed to be released on bail on each of them furnishing a personal bond for a sum of Rs.50,000/- with one surety each in the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
