The short issue arises for consideration in this petition is whether while deciding the Election petition, the earlier direction for framing issues were complied with or not.

Without entering into further dispute, learned counsel for respondent No.3, the election petitioner submits that the matter may be remanded to the Election Tribunal with a direction to frame issues as directed earlier by this Court and expeditious disposal of election petition.

In view of the aforesaid consideration, the impugned order is set aside and the matter is remanded to the Election Tribunal to frame specific issues as directed by the Division Bench vide its order dated 05.01.2016 in Writ Appeal No.664 of 2015 (Smt. Shivkala Vs. State of Chhattisgarh and others). The Election Tribunal shall do well to complete the trial and decide the matter in accordance with law.

The petition is accordingly disposed off.
