A report received from Sessions Judge, Balrampur at Ramanujganj that office of the District & Sessions Judge, Balrampur had not sent the order of this Court dated 08.01.2019 passed in M.Cr.C. No.9368/2018 due to inspection done by High Court officials. 2.

District & Sessions Judge, Balrampur is directed to initiate departmental proceeding against the erring officer. 3.

This is third bail application. The first bail application of the applicant was rejected on merits by this Court vide order dated 24.08.2018 passed in M.Cr.C. No.5430/2018 and second bail application was also rejected on merits by this Court vide order dated 08.01.2019 passed in M.Cr.C. No.9368/2018.

Counsel for the applicant submits that the applicant seeks permission of this Court to withdraw the instant bail application and direction may be issued to the trial Court to dispose of case within stipulated time as framed by this Court. He further submits that liberty may be granted to file subsequent bail application if the case is not decided within a stipulated time.

Permission is granted, as prayed for.

Accordingly, the bail application is dismissed as withdrawn with the aforesaid liberty. However, the trial Court is directed to expedite the trial

and conclude the same expeditiously preferably within a period of 45 days from the date of receipt of certified copy of this order. 7.

Additional Registrar (Judl.) is directed to communicate the copy of this order immediately to District and Sessions Judge, Balrampur at Ramanujganj.
