1. Heard.

2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.137/2021 registered at Police Station Khadgawan, District Koriya (CG) for the offence punishable under Section 376 of the IPC.

3. The applicant has committed forcible sexual intercourse with the prosecutrix, aged about 35 years at about 9:00 p.m. on

MCRC No. 3915 of 2021 1/5/2021, for which, the FIR has been lodged on the next date.

4. Considering the nature of allegations, I am not inclined to release the applicant on regular bail at this stage.

5. Accordingly, the bail application is dismissed. However, liberty is reserved in favour of the applicant to revive the prayer after examination of the prosecutrix.
