Divyanarayan Basara S/o Shri Alekha Basara Aged About 32 Years R/o Devadih Ward No. 13 Jharsuguda, P. S. Jharsuguda, District Jharsuguda Orissa. --- Petitioner
Versus
State of Chhattisgarh Through The Station House Officer, G R P, District Bilaspur Chhattisgarh. --- Respondent 26.06.2018 Mr. Dhirendra Mishra, counsel for the petitioner. Mr.S.R.J. Jaiswal, Panel Lawyer, for the State. This is first bail application.
As per the prosecution case on 16.03.2018, while the applicant was transporting the contraband cannabis from railway platform, a raid was conducted and from the possession of the applicant 8 Kgs., of Ganja was recovered on the spot.
Learned counsel for the applicant submits that the applicant has been falsely implicated and the cannabis so seized do not belong to the applicant and it was seized from an open place.
Per contra, learned State Counsel opposes the bail application.
Perused the case diary. Prima facie, it appears that from the possession of the applicant, 8 Kgs., of cannabis was recovered. Therefore, I am not inclined to allow this bail application. Accordingly, it is rejected. Sd/- R a o GOUTAM BHADURI JUDGE
