For Respondents :

Hon'ble Shri Justice P. Sam Koshy Order on Board 27/04/2018 1.

Grievance of the Petitioner in the instant case is to the issuance of the suspension order, dated 24.2.2018 (Annexure P-1). 2.

Learned Counsel for the Petitioner submits that as per rules the chargesheet has to be issued within a period of 45 days but in the instant case the charge-sheet has been issued much beyond the period of 45 days and therefore the order of suspension ought to have been revoked. 3.

Learned Counsel for the Petitioner further submits that the Petitioner has already preferred an appeal against the said order before Respondent No.2 but the same also stands pending till date. 4.

Given the facts and circumstances of the case, this Court is of the opinion that ends of justice would meet if the present writ petition itself is disposed of with a direction to Respondent No.2 to decide the appeal preferred by the Petitioner at the earliest preferably within a period of 60 days from the date of receipt of certified copy of this order. The appellate authority would also consider the necessity of continuing with the suspension order. Let a

reasoned order be passed by the appellate authority within the time stipulated by this Court.

5.

With the aforesaid direction/observation, the writ petition stands disposed of.
