Learned State counsel prays for grant of leave to appeal. 2.

Taking into consideration of the submission of learned State counsel that the evidence of the respondent-accused leaving the spot, where the dead body was lying, bloodstained knife and clothes of the accused as also motive has been wrongly disbelieved by the trial Court, we are inclined to grant leave to appeal.

Accordingly, the application (Cr.M.P.No.598 of 2021) is allowed. Leave is granted.

Let appeal filed by the State be registered as Acquittal Appeal and listed for further orders.
