Challenge in the present writ petition is to the order dated 10.3.2017 (Annexure P-1) whereby the Respondent No.2 has issued an order for taking the Petitioner back in services after cancelling the termination order dated 2.9.2016. However, while taking the services back, the Petitioner has been granted a fresh appointment thereby the Petitioner's earlier service between 2011 to 2016 gets wiped out.

Perusal of impugned order reflects that it has been issued by the Chief Executive Officer, Janpad Panchayat, Masturi. 3.
The said order is an appealable order under the rules. 4.
In view of the fact that under challenge itself is an order passed more than one year ago and that it does not appear that the Petitioner has preferred an appeal exhausting the remedy available under the law. 5.
This Court therefore is not inclined to entertain the present writ petition at this juncture, reserving the right of the Petitioner to avail the remedy of appellate authority within a period of 15 days from today. The appellate
authority shall consider the appeal of the Petitioner and shall pass a speaking order within a further period of 60 days from the date of receipt of appeal. 6.
