Petitioner was promoted as AG-II on 19-9-2013 and was posted at Government Naveen Mahavidhyalay, Mainpur. He submitted a representation on 27-9-2013 for his posting at Government J.Yoganandam

Chhattisgarh Mahavidhyalay, Raipur. The present writ petition is filed for deciding this representation.

According to learned counsel for the petitioner, representation filed by respondent No.4 has been allowed but petitioner's representation has not been considered.

It is to be seen that on 10-7-2014, the petitioner was transferred from Mainpur to Pakhanjur, against which he preferred WP (S) No.3372/2014, which was disposed of with a direction to consider petitioner's representation. Representation filed by the petitioner has been allowed, vide order dated 21-11-2014, therefore, it cannot be said that the Government has not at all addressed petitioner's grievance at any point of time. The petitioner cannot be posted at the place of his choice. If this Court initiates entertaining petitions filed by the employees for issuing direction to consider their cases for choice posting, this Court would virtually takeover the State Government's administration. This will not only open a floodgate of litigation but will cripple the State Administration. 4.

The writ petition is without any substance. It is accordingly dismissed with cost of Rs.10,000/- to be deposited with the Chhattisgarh High Court Bar Association. If the cost is not deposited within a period of one month from today, the concerned Tahsildar shall issue Revenue Recovery Certificate against the petitioner for recovery of the amount. A copy of this order be sent to the Tahsildar, Mainpur for doing the needful if the petitioner fails to satisfy the Tahsildar that cost has been deposited by him. JUDGE ashu
