1. Present petition has been filed questioning the order dated 5-6-2006.

2. Learned counsel for the petitioner submits that the petitioner has already been selected, therefore, the Project Officer could not have sought further applications.

3. Learned State counsel would support the impugned order.

4. A careful perusal of the aforesaid order would show that by the said order, the Project Officer has simply given an opportunity to the candidates who have been deprived of submitting their candidature for the post of Aanganbadi Karyakarta and challenging the same, this writ petition has been filed on 27-7-2006 after delay of one month and now, the period mentioned in the order dated 5-6-2006 had already expired. Issuance of appointments orders in pursuance of fresh selection has been stayed by

this Court. It is stated at the Bar that in the said Aanganbadi Centre of Bhagwanpur, only six candidates had made their candidature and five have been declared ineligible. The matter is remitted back to the Project Officer to take decision afresh in this regard, as the period given in Annexure P-6 had already expired. The Project Officer may continue the recruitment process already initiated and take decision or initiate fresh recruitment process in accordance with law on the basis of material available on record. Such decision will be taken within 30 days form the date of receipt of a copy of this order.

5. With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
