1. The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.144/2020 registered in Police Station: Jashpur District Jashpur for offence under Section 307/34 of the IPC.
2. At about 4 am on 14.7.2020, 6 accused persons including the present applicant assaulted the injured Dashrath Prasad by hands and fists.
3. The present applicant was not named in the FIR. His identity was subsequently established in the TI parade. The bail application of coaccused Rohit Das has been allowed in MCRC No.6326/2020, though in the same order, the bail application of Jitendra Ram has been
MCRC No. 3953 of 2021 dismissed as he was having criminal antecedents of his involvement in 5 more criminal cases.
4. Considering that the present applicant is in jail since 17.1.2021, his name was not mentioned in the FIR and that co-accused Rohit Das has already been released on bail, I am inclined to release the present applicant on bail.
5. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
