Shri Rajendra Tripathi, Panel Lawyer on advance copy Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 19/06/2017 Though number of grounds have been urged in the petition to challenge legality and validity of selection and appointment of respondent No.5, learned State counsel pointed out and learned counsel for the petitioner could not dispute that there is a remedy of filing appeal before the Collector. I do not find any extra ordinary reason, why this petition should be entertained without insisting on exhaustion of alternative remedy. Therefore, in these circumstances, this petition is finally disposed off with liberty to the petitioner to prefer appeal before the Collector.

In case, the appeal is preferred within a period of 30 days from today, the Collector shall decide the appeal on merits without entertaining any objection to the limitation aspect.
