The applicant has preferred this bail application under Section 439 of the Cr.P.C. for grant of bail as he has been arrested in connection with Crime No.142/2020, registered at Police Station Pratappur, District Surajpur, C.G., for the offence punishable under Sections 302, 394, 34, 120(B) of the Indian Penal Code and Sections 25, 27 of the Arms Act. 3.
Applicant and co-accused Shahid Khan & Sarwar Khan hired the Scorpio vehicle, owned by the brother of the deceased
MCRC No.4264 of 2021 (Chitreng Kumar Sahu) namely; Dushyant Kumar Sahu, which was driven by the deceased. The dead body of the deceased was found on 4-9-2020.

During investigation, the travel agents, through whom the accused persons have hired the vehicle, have identified them. Moreover, mobile set belonging to the deceased has been recovered from the possession of this applicant. There are evidence of call details, CCTV footage, etc.

Considering the quality of evidence and further considering the fact that the bail applications of co-accused Shahid Khan & Sarwar Khan have been dismissed by the coordinate Bench of this Court as withdrawn by common order dated 8-3-2021 passed in M.Cr.C.Nos.644 of 2021 & 1395 of 2021, I am of the opinion that present is not a fit case to release the applicant on regular bail.
