Hon'ble Shri Justice P. Sam Koshy Order On Board 13/06/2017 The petitioner, by way of this petition, seeks a direction to the respondents to consider her case for grant of compassionate appointment. 2.

The claim of the petitioner is that, her Husband while working as Shiksha Karmi Grade-III died in harness on 24/10/2012. According to petitioner, she moved an application for compassionate appointment in the year 2013, but the same was turned down on 26/09/2016 on the ground that she does not possess the minimum requisite qualification for the appointment on the post of Shiksha

Karmi Grade-III. Subsequently, the petitioner is said to have made a representation to the extent that in case if the petitioner does not have the requisite qualification for being considered as Shiksha Karmi, her case may at least be considered for compassionate appointment as a Class IV employee like Peon etc. The said application is pending and till date, no decision has been taken on the said application by respondent No.4. 3.

At this juncture, without entering into the merits of the case, the present petition is disposed of with a direction to the respondent No.4 to decide the claim of the petitioner wherein she has stated that her case may be considered even against a Class-IV post like Peon etc. Let this exercise be done by respondent No.4 within a period of 60 days from the date of the certified copy of the order being placed before respondent No.4. It shall be the responsibility of the petitioner to produce the certified copy of this order along with a fresh claim application mentioning the earlier claim made by her within a period of two weeks from the date of receipt of certified copy of this order. 4.
